Dlgs 33/2013 – Article 40 – Publication and access to environmental information
1. In the field of environmental information are the enhanced protection provisions already laid down in article 3-e of Legislative Decree 3 April 2006 n. 152, by law 16 March 2001, n. 108, and by Legislative Decree 19 August 2005 n. 195.
2. The departments referred to in article 2, subparagraph 1, Letter b), Legislative Decree. 195 of 2005, publish, on their Web sites and in accordance with the provisions of the present Decree, the environmental information referred to in article 2, subparagraph 1, letter a), Legislative Decree 19 August 2005, # 195, holding for the purposes of its institutional activities, and the reports referred to in article 10 of Legislative Decree. This information must be given specific emphasis within a special section called "environmental information».
3. Are without prejudice to the exclusion of the right of access to environmental information referred to in article 5 Legislative Decree 19 August 2005, n. 195.
4. The implementation of the obligations laid down in this article is not in any case be subject to the conclusion of the agreements referred to in article 11 Legislative Decree 19 August 2005, n. 195. Are subject to the effects of the agreements already concluded, should ensure environmental information levels higher than those guaranteed by the provisions of this Decree. It is understood the power to enter into further agreements pursuant to the same article 11, in respect of environmental information levels guaranteed by the provisions of this Decree.
